BERIN IP AGENCY PARTICIPATED ON THE 83rd COUNCIL OF THE EUROPEAN PATENT INSTITUTE

The delegation of the Agency for Intellectual Property "Berin" in composition of: prof. Prof. Dr. Gjorgji Filipov, MA Maria Koseska and B.Sc. Eng. Liljana Filipova (Associate Member) participated in the work of the 83rd Council of the European Patent Institute (EPI) that took place in Warsaw (Poland) on November 17-19th, 2017.

 During the work of the Council the new  members of the appropriate committees of the EPI were elected for the period 2017-2020. The representatives of the IP Agency Berin were elected in three EPI Committees: Maria Kjoseska in the Committee for Professional Enforcement, Bogoljub Ilievski in the Committee for European Patent Practice and Vanco Damjansky in the Committee for Disciplinary Procedure. The Macedonian European patent attorneys have representatives in three Committees: Litigation, Education and By-Law.

In addition to the Council was held a seminar on "Patent infringement litigation in EU jurisdictions and the UPC Perspective".The two-day work and friendship with the other 160 colleagues, representing 12,500 patent attorneys from the countries that had ratified the European Patent Convention, provided a real opportunity for exchange of experiences and ideas for the further development of the European Patent Institute and the cooperation of the attorneys within their competencies, both with colleagues, and with their business partners.

"BERIN" AT "CEFTA" PANEL DISCUSSION ON "INTELLECTUAL PROPERTY RIGHTS IN BOOSTING OF TRADE AND INVESTMENT"

On 16.12.21 was held a panel discussion entitled "Intellectual Property Rights (IP) in boosting to trade and investments" within the Conference "CEFTA Week 2021 - 15 years of trade", which took place in Skopje, MK from 13-16 December 2021. This panel was addressed by prof. Dr. Gjorgji Filipov, founder of the Agency "Berin"; Mladen Vukmir, MA, Head of the CEFTA IPR Project (Zagreb); Jasmina Suljović, Lawyer (Sarajevo); Ignacio de Medrano Caballero, Head of the Office for International Cooperation, European Intellectual Property Office (EUIPO), (Alicante); Dragana Ranitović, Director of IP, Ministry of Economic Development, (Podgorica) and Marija Božić, Institute of IP, (Belgrade). The discussion was moderated by Aurelia Iseanu from the Secretariat of the Central European Free Trade Agreement (CEFTA) (Brussels). The conference was attended by colleagues: Liljana Filipova, co-founder and European patent attorney of "Berin International GmbH", Vienna; DI Bogoljub Ilievski, head of the Patent Department in "Berin", vice president of the European Patent Institute; M.Sc. Marija of the Sector for Trademarks and Ivona Sekulovska, MA, Representative for IS and about fifty representatives from all CEFTA countries.
 
The first part of the panel discussed the importance of IPR in encouraging trade in CEFTA and how it can generate economic growth, attract investment and new areas of development. Aurelia Iseanu gave a brief introduction and then asked questions to each of the panelists. Common questions were: 1. Why do we need to take seriously the role of IPR in economic development, trade promotion and investment attraction? and 2. How can we ensure that common rules and minimum standards for the protection and enforcement of IP rights between CEFTA Parties serve the purpose without creating unnecessary costs and potential barriers to trade? How to deal with business concerns that rights acquired in one market do not apply to another CEFTA market?
The representative of MK, Dr. Filipov, was asked a special question: "Recently, the Investment Forum for the Six Chambers of the Western Balkans published a report indicating that IS is ranked among the non-tariff barriers, which are considered an obstacle to do business in the region. “Given that your company offers a range of IP services in the region and beyond, including the EU countries, what do you think is added value for the business if it protects its IP rights while ensuring that no additional barriers to trade are created?"
 
In the second part of the panel, the discussants initiated a series of questions where Dr. Filipov talked about the not so common, but very unpleasant, situations when some domestic offices for IS or EUIPO when assess whether to recognize a trademark application and register it, instead the provisions of the law, international conventions and agreements use as a criterion for decision the affiliation of the company, which seeks protection in the country before which the Office has been filed or which is in the EU or outside the EU. Filipov also referred to the disputes over geographical names, with EUIPO representative Medrano Caballero responding that such disputes exist between interested companies from the EU itself, which is not unusual, and EUIPO must make a decision if no compromise solution was found between the parties to the dispute.
 
The moderator, Ms. Iseanu, stressed that the purpose of the Discussion is to discuss the next steps to enhance cooperation on IP rights within CEFTA, possible recommendations, feasible solutions that could be implemented in CEFTA. On this topic, Filipov proposed to consider the possibility of creating a joint "Office for Trademarks and Industrial Designs" for all CEFTA members, following the example of Belgium, Netherlands and Luxembourg. This would eliminate the obstacles and barriers to free trade caused by protectionism in the IP, which, although not a major obstacle, still, according to polls, participates with a 15% share in the total non-tariff barriers.
 
Having in mind that besides the panel discussion, the European Intellectual Property Office (EUIPO) held a technical workshop for the employees of the CIS offices of the CEFTA member countries, we evaluate CEFTA Week 2021 in North Macedonia as a successful event.

AGENCY "BERIN" IN THE DEBATE FOR THE FIRST VERSION OF THE MACEDONIAN "NATIONAL STRATEGY FOR INTELLECTUAL PROPERTY (2022-2026)

Marija Kjoseska, M.Sc. eng. arch., Macedonian and European patent attorney and B.Sc. eng. Bogoljub Ilievski, Macedonian and European Patent Attorney and Vice President of the European Patent Institute (EPI) as representatives of the BERIN Agency actively participated in the debate on the proposed first version of the "National Intellectual Property Strategy (2022-2026) of MK". Among other things, they stressed the need for electronic filing of applications before the State Office of Industrial Property (SOIP) and the need for changes in the laws and bylaws of the "Law on Industrial Property", which will contribute to improving the procedures for acquiring the rights of industrial property (patents, trademarks and industrial designs).
 
Previously, the project team leader, Zeljko Topic, MA, Croatian and European patent attorney, and the Croatian and European patent representatives and Prof. Dr. Valentin Pepeljugoski, Macedonian and European patent attorney reviewed the process of preparation of the National Strategy and implementation of intellectual property rights.
 
In the name of the IP representatives from the Republic of North Macedonia, a review of this version of the strategy was given by Marin Gavrilovski, MA, MKD representative for industrial property. Prof. Romana Matanovac Vuckovic, President of the Croatian Music Institute, spoke about the protection of the collective management of IP rights in the EU - experiences from Croatia. Also, Prof. Dr. Jadranka Dabovic - Anastasovska poke on the topic "Industrial property rights and innovations in EU legislation on IP".

BERIN IP AGENCY AT 11TH MUNICH IP CONVENTION

The 11th Convention and Intellectual Property Fair (IF) which took place from 21-24 November 2021 in Munich (Germany) was attended by the Berin Agency with two representatives, prof. Dr. Gjorgji Filipov, EP and MK patent attorney and B.Sc. eng. Kristina чоaвскаovska, MK patent attorney. The convention was held in accordance with the measures against the spread of Covid-19. About 650 colleagues from 55 countries participated in 75 exhibition stands and in three panel sessions, of which 350 on the spot and the rest online. Over 30 speakers spoke in parallel panels, and more than 20 roundtable sessions were held.

Topics covered were: "Strengthening the culture of innovation", "Cooperation agreements - collaboration between competitors", "Patenting of artificial intelligence", "Technological monitoring in a diversified global economy", "Non-patent literature - hidden treasury", "Use machine learning and artificial intelligence in patent search and categorization "," Transformation of IP into business success", "Patent, scientific and business databases, strategic decision assistant", "State of the art in IP services: Technological differences", "The Future of IS" and many others. The Berin representatives were ones of the few from the region of Southeast Europe.

At the panel session "New Paradigm for a New Decade: "Integrated Management for the Life Cycle of IS" and at the round table" End-to-End IP Management - an Insight into Integrations, APIs and Cloud Based Blended Analytics", with its oral presentation ( intervention) participated and prof. Filipov. In the first session, he highlighted the fact that interest in the add-on (SPC) certification is growing rapidly, hence the IP lifecycle management software needs to undergo the patent quadrant "Low attractiveness of the technology area / Obsolete protection" of the patents, which should be abandoned if they are in the field of "pharmacy". In the second session, Filipov stressed the need to give time for the transformation of IP management software in the classical sense (own server, computer, CD or USB) and the insistence of the latest generation of engineers, everything to be based on the Cloud (Google, Amazon, Microsoft and so on). He believes that a hybrid cloud should be used first, where it is allowed to store certain (important for the company and its customers) data in its physical IT infrastructure, while using the services of public "clouds" mentioned earlier.

The Convention was attended by IP directors from BMW, Siemens, Vodafone, CeramTec, Infineon Technologies, Philips, Rheinmetall ABP, Hitachi, Atlas Copco, Danish Patent And Trademark Office, Nordic Patent Institute, Swiss Federal Institute of IP, Hoffman-La Roche and others. companies, as well as representatives of the largest IP companies in the world (Clarivate, Dennemeyer, Questel). The highlight of the event was the performance of Mrs. Ellen Lohr, a fast car racer, participant in the Rally Dakar, former German DTM champion, who spoke on "Successful coping with permanent crises", alluding to the crisis in which we are all forced to work , and we in the field of IP, often repeating the statement - "Success is not a random product."

BERIN AT THE 42nd MAKINOVA AND 19th EKONOVA

From November 8-10, 2021 The 42nd edition of MAKINOVA was held, the International Exhibition of Inventions, Innovations, New Technologies and Products, Technical Advances, Industrial Design, Trademarks, Youth Research and Creativity, as well as the 19th edition of ECONOVA, International Exhibition of Innovations, inventions and ideas aimed at promoting environmental innovation.

The Intellectual Property Agency BERIN has traditionally taken part in both events. Namely, B.Sc. Eng. Kristina Chachovska from the Patent Department of the BERIN Agency, was a member of the jury, which this year evaluated the exhibits on line (virtually).

The awards ceremony took place on November 17, 2021. in hotel Continental, where the two representatives from BERIN, Kristina Chachovska and Bogoljub Ilievski, presented the special awards from BERIN for the most successful participants in the category "young participants".

In the category "MAKINOVA 2021" - Young participants, the award from BERIN was taken by Martin Milchevski and Luka Damjanov from SETUGS "Mihaljo Pupin" - Skopje, under the mentorship of Professor Daniela Sandeva, for the project "LUMA-Ergonomic chair".

In the category "EKONOVA 2021" - Young participants, the award from BERIN went to Gala Arsovska from OSTU "Natse Bugјoni" - Kumanovo, who under the mentorship of Professor Slavica Karanikic, developed the project "Natural protection of bees from parasites".

The organizer of the two manifestations "Narodna Tehnika" awarded Acknowledgments to BERIN, for the long-term support of both manifestations, and to Kristina чоaвскаovska, for participation in the jury.

EUROPEAN PATENT INSTITUTE - C91 COUNCIL MEETING

18.11.2021

EPI C91 Council meeting took place on 13 November 2021 by videoconference. A total of 188 participants attended the meeting, including three representatives from MK: B.Sc. eng. Bogoljub Ilievski in the capacity of Vice President of the Institute and prof. Dr. Gjorgji Filipov (the two permanent members of the Council) and M.Sc. eng. Marija Kjoseska, as a substitute member of the Council.

Council members heard a presentation from EPO President, Mr António Campinos, on the latest developments at the EPO. The presentation was followed by a Q&A session which focused on the following topics: EQE, EPO Academy, oral proceedings by ViCO, , quality, digitalization, teleworking and cybersecurity.

Council adopted the strategic plan of the Institute that was first presented during the last Council meeting (C90), and voted the budget for 2022.

EPO and WIPO sign Memorandum of Understanding

On 8 November  2021, EPO President António Campinos met online with Mr Daren Tang, Director General of the World Intellectual Property Organization (WIPO). The organisations renewed their commitment to further improving the international patent system's support for innovation and signed a new Memorandum of Understanding on bilateral co-operation. 

The agreement aims at improving the procedural framework of the Patent Cooperation Treaty (PCT) with a view to increasing its attractiveness and efficiency for applicants. Further focus areas for co-operation between the EPO and WIPO include classification, data exchange and the dissemination of patent information. 

The organisations emphasised the need to support the innovation ecosystem with regard to sustainable growth, including when it comes to fostering synergies between the EPO's network of patent information centres (PATLIBs) and the WIPO's Technology Innovation Support Centres (TISCs).

Moreover, the EPO and WIPO will join forces on enhancing their respective information technology systems in order to optimise workflows and processes. This includes the digitalisation of all paper-based bilateral PCT dataflows by the end of 2023.
